Terms of Service

1. Who may use the Service

You must be at least 18 years old and able to form a binding contract to create an account. Mandarin Quest is parent-directed: an adult creates the account, sets up a profile for each child, and is responsible for supervising the child’s use.

2. Your account

You are responsible for activity under your account and for keeping your sign-in secure. You agree to provide accurate information and, where possible, to use a first name or nickname for child profiles.

3. Subscriptions, trial, and billing

Mandarin Quest offers a free tier with a limited number of lessons per day, and a Premium subscription with unlimited lessons for US$4.99/month. We also offer a 14-day free trial that does not require a credit card.

On the website, paid subscriptions are billed through Stripe. In the iPhone and iPad app, subscriptions are billed through your Apple Account and managed by Apple, with the price shown before purchase for your App Store storefront. Subscriptions renew automatically until canceled in the applicable Stripe billing portal or Apple subscription settings. Cancellation stops future renewals and takes effect at the end of the current billing period. Deleting a Mandarin Quest account does not itself cancel an Apple subscription. Except where required by law or Apple policy, payments are non-refundable for partial periods. Prices may change, and notice will be provided as required before a change applies.

4. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• copy, scrape, resell, or commercially redistribute the content or curriculum;
• reverse engineer, interfere with, or attempt to gain unauthorized access to the Service or other users’ data;
• upload unlawful, harmful, or infringing content.

5. Content and intellectual property

The Service and its content — lessons, curriculum, text, audio, graphics, and the Bubble 波波 character — are owned by Cedarwind or its licensors and protected by intellectual-property laws. We grant you a limited, personal, non-commercial, non-transferable license to use the Service for your family’s learning.

Some material is used under open licenses; for example, certain Zhuyin (注音) pronunciation recordings are from Taiwan’s Ministry of Education and used under CC BY 4.0. Such material remains under its own license.

You retain ownership of the information you enter (such as child names) and grant us a license to use it solely to operate and provide the Service.

6. Educational disclaimer; no affiliation

Mandarin Quest is a supplemental learning tool. We align our curriculum to Taiwan Ministry of Education (教育部) grade levels, but we are independent and are not affiliated with, sponsored by, or endorsed by the Ministry of Education or any school. We do not guarantee any particular learning outcome.

7. Third-party services

The Service relies on third parties, including Apple, Google, RevenueCat, Stripe, and Supabase. Your use of those features may also be subject to their terms and policies. App Store purchases are additionally subject to Apple’s applicable media-services terms.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, Cedarwind will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US$50.

10. Indemnification

You agree to indemnify and hold Cedarwind harmless from claims arising out of your misuse of the Service or violation of these Terms.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Massachusetts for any dispute not subject to arbitration or small-claims court.

13. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date and, for material changes, take reasonable steps to notify you. Continued use after changes means you accept the updated Terms.
